Buying a Property? Get the Contract Reviewed Before You Sign or Bid

A Contract for Sale contains the legal terms of the purchase as well as important information about the property. Having the contract reviewed before you sign can help you understand your obligations, identify conditions that may need attention and raise issues before you become legally bound.

Golottas Solicitors can review the contract and help you understand matters such as:

  • Deposit requirements
  • Settlement terms
  • Special conditions
  • Title documents
  • Inclusions and exclusions
  • Matters requiring further investigation
  • Proposed amendments or negotiations

Buying at Auction?

Contract review is particularly important before an auction. In NSW, a successful bidder is generally required to sign the contract and pay the deposit immediately, and there is no cooling-off period after purchasing at auction.

If you are considering bidding on a property, having the contract reviewed beforehand can help you understand the terms before auction day.

FAQs

What does conveyancing involve in NSW?

Conveyancing is the legal process involved in transferring ownership of property from a seller to a buyer. It can include preparing or reviewing the Contract for Sale, conducting relevant property and title enquiries, dealing with exchange, preparing for settlement and completing the electronic transfer of ownership.

When should I have a property contract reviewed?

Ideally, you should have the Contract for Sale reviewed before you sign it. Getting advice early gives you an opportunity to understand the terms, identify matters requiring further investigation and discuss any proposed changes before you become legally bound. Contract review is particularly important before bidding at auction.

How long does property settlement usually take in NSW?

Settlement commonly occurs around six weeks after contracts are exchanged, although a different settlement period can be negotiated and specified in the contract. The time required will depend on the transaction and the terms agreed between the parties.

Is there a cooling-off period when buying property in NSW?

For many residential property purchases by private treaty, the buyer has a five-business-day cooling-off period after exchange. Different rules can apply to off-the-plan purchases, and there is generally no cooling-off period when purchasing at auction or when contracts are exchanged on the same day after an auction. Cooling-off rights can also be waived in certain circumstances, so legal advice should be obtained before doing so.

Can Golottas Solicitors assist with residential and commercial property matters?

Yes. Golottas Solicitors assists with residential and commercial property transactions as well as contract preparation and review, settlements, commercial and retail leases, refinancing and other property-related matters.

Can Golottas Solicitors assist first home buyers?

Yes. We can assist first home buyers with the conveyancing process, including reviewing the contract, progressing the purchase through exchange and settlement and helping you understand the legal requirements associated with the transaction. Depending on your circumstances and the property being purchased, NSW Government grants or transfer duty concessions may also be available.
